REGULAR MEETING

AUGUST 23, 2005

 

 

         The Pittsgrove Township Committee met in the Meeting Room on August 23, 2005, Mayor Peter I. Voros presided. Committee members present were Linda A. DuBois, Maxine C. Hargus and Kenneth P. Martin. Jeffrey T. Ridgway, Sr. was absent. Township Solicitor, Benjamin C. Telsey was also present.

 

CALL MEETING TO ORDER/FLAG SALUTE/ROLL CALL

 

         Mayor Voros opened the meeting with a salute to the flag and reading of the Open Public Meeting Act.

 

APPROVAL OF MINUTES OF PREVIOUS MEETINGS

 

         On a motion by DuBois and seconded by Hargus, the minutes of the June 28, 2005 Executive Session, July 26, 2005 Regular Meeting and July 26, 2005 Executive Session were approved as submitted.

PUBLIC HEARINGS

 

         A public hearing was held on an ordinance entitled An Ordinance Amending 60-82 Of The Code Of The Township Of Pittsgrove, New Jersey Entitled “Signs”. There being no comments from the public, said hearing was closed on a motion by Martin and seconded by Hargus.

Vote:  All in favor

 

On a motion by DuBois and seconded by Martin, the aforementioned Ordinance No. 07-2005 was adopted on second reading for final passage.

         A public hearing was held on an ordinance entitled An Ordinance Repealing Section 60-61 Of The Code Of The Township Of Pittsgrove Entitled “Existing Lots”. There being no comments from the public, said hearing was closed on a motion by Hargus and seconded by Martin.

Vote:  All in favor

 

On a motion by Hargus and seconded by DuBois, the aforementioned Ordinance No. 08-2005 was adopted on second reading for final passage.

MISCELLANEOUS BUSINESS

 

         On a motion by DuBois and seconded by Hargus, RESOLUTION NO. 2005-127 AUTHORIZING THE RELEASE OF PERFORMANCE GUARANTEE (ARCHER’S SIDING, INC.) was approved as read.

STANDING COMMITTEE REPORTS

 

         ADMINISTRATION & PERSONNEL (Hargus/Voros)

 

         On a motion by Hargus and seconded by Martin, RESOLUTION NO. 2005-128 APPOINTING A CONSULTANT TO IMPLEMENT THE ACCESSORY APARTMENT PROGRAM SECTION OF THE TOWNSHIP OF PITTSGROVE’S AFFORDABLE HOUSING PROGRAM was approved as read.

         On a motion by Hargus and seconded by DuBois, the request from Nancy L. Huster, Land Use Administrator to carry over eleven (11) vacation days to be taken in

September and November 2005 was approved.

         On a motion by Hargus and seconded by DuBois, the request from Joanne M. Baranowski, Assistant Treasurer/Administrative Assistant to carry over one (1) vacation day to be taken in September 2005 was approved.

ECONOMIC DEVELOPMENT (DuBois/Hargus)

 

         The Township Committee acknowledged receipt of the memorandum from the Economic Development Committee regarding its recommendation for subcommittee formation.

 

         EMERGENCY MANGEMENT, FIRE & LIGHTING (DuBois/Ridgway) - No business.

 

         FINANCE (Martin/Voros)

 

         On a motion by Martin and seconded by Hargus, RESOLUTION NO. 2005-129

PAYMENT OF BILLS was approved as read.

         On a motion by Martin and seconded by Hargus, RESOLUTION NO. 2005-130 AUTHORIZING APPROVAL OF THE CORRECTIVE ACTION REPORT FOR THE 2004 AUDIT was approved as submitted.

         On a motion by Martin and seconded by Hargus, “AN ORDINANCE REAPPROPRIATING $26,000 PROCEEDS OF OBLIGATIONS NOT NEEDED FOR THEIR ORIGINAL PURPOSES IN ORDER TO PROVIDE FOR THE CONSTRUCTION OF FOUR-BAY POLE BARN IN AND BY THE TOWNSHIP OF PITTSGROVE, IN THE COUNTY OF SALEM, NEW JERSEY” was approved on first reading. The second reading and public hearing will be held on September 13, 2005 at 7:30 p.m. in the Municipal Building, 989 Centerton Road, Pittsgrove, New Jersey afterwhich the ordinance will be considered for final passage.

         On a motion by Martin and seconded by Hargus, “AN ORDINANCE PROVIDIDNG A SUPPLEMENTAL APPROPRIATION OF $26,000 FOR THE COMPLETION FINANCING OF A FOUR-BAY POLE BARN IN AND BY THE TOWNSHIP OF PITTSGROVE, IN THE COUNTY OF SALEM, NEW JERSEY AND AUTHORIZING THE ISSUANCE OF $26,000 BONDS OR NOTES OF THE TOWNSHIP FOR FINANCING PART OF THE APPROPRIATION” was approved on first reading. The second reading and public hearing will be held on September 13, 2005 at 7:30 p.m. in the Municipal Building, 989 Centerton Road, Pittsgrove, New Jersey afterwhich the ordinance will be considered for final passage.

         INTERLOCAL & SHARED SERVICES (DuBois)

 

         On a motion by DuBois and seconded by Hargus, RESOLUTION NO. 2005-131 PITTSGROVE MUNICIPAL ALLIANCE GRANT CALENDAR YEAR 2006 was approved as read.

ORDINANCE REVIEW & LEGISLATIVE (Hargus/Ridgway) - No business.

 

         RECREATION & OPEN SPACE (Ridgway/DuBois)

 

         On a motion by DuBois and seconded by Martin, the park request from Risea Rodgers to use the Norma Recreation Area for a family barbeque on September 3, 2005 was approved as recommended by the Recreation Advisory Committee.

Vote:  All in favor

 

The Recreation Advisory Committee is to be reminded that “Requests to Use Township Facilities” should first go before them for recommendation.  Such recommendation is then presented to the Township Committee for its consideration and action.  Requestors should be advised that applications require formal approval and must be submitted far enough in advance to allow for review and recommendation by the Recreation Advisory Committee and subsequent approval by the Township Committee. It was suggested that the protocol for such requests appear in the upcoming newsletter.

 

         ROADS & TOWNSHIP FACILITIES MAINTENANCE (Ridgway/Voros)

 

         Committeewoman Hargus acknowledged receipt of the letter from Gloria Noto, Cumberland County Clerk, who was involved in a recent auto accident at the intersection of Gershal Avenue and Almond Road. Mayor Voros commented that during the reconstruction of the Route 56/Landis Avenue Bridge (Maurice River) a temporary traffic light will be installed at the intersection. The Township Committee intends to request that the temporary light remain once installed due to traffic safety concerns at the intersection.

 

         The Township Committee recognized long time residents Harold and Elsie Huster as volunteers of the Adopt-A-Road Program.  For the past nine years, they could often be seen maintaining the appearances of Sand Bridge Road and Mill Road. The Huster’s also received a Volunteer Award from the Director of the NJ Clean Communities Council at a banquet held May 20, 2004 in New Brunswick, NJ.  A Certificate of Appreciation will be forwarded to them for their local efforts as they were unable to attend the meeting.

 

         On a motion by Hargus and seconded by Martin, RESOLUTION NO. 2005-132 Issuing Change Order Number CO-01 To The Contract To Provide An Addition And Renovations To The Pittsgrove Township Senior Center was approved as read.

         On a motion by Hargus and seconded by Martin, RESOLUTION NO. 2005-133 Authorizing That Application Be Made To The New Jersey Department Of Community Affairs For The Purpose Of Making Improvements To The Pittsgrove Township Senior Center was approved as read.

Vote:  All in favor

 

         On a motion by Martin and seconded by Hargus, the request submitted by Ken Tuller to use two of the township tents free of charge for a benefit “Lost at Sea Memorial” on September 18, 2005 at Brad’s Red Tavern was approved.  Mr. Tuller was required to post standard deposits for the tents and execute a Hold Harmless Agreement.

         SHADE TREE (Hargus)

 

         On a motion by Hargus and seconded by DuBois, an ordinance entitled An Ordinance Amending The Code Of The Township Of Pittsgrove To Add Chapter 23 To Part I Entitled “Shade Tree Advisory Committee” is to be forwarded to the Gloucester, Cumberland and Salem County Joint Insurance Fund and Shade Tree Advisory Committee for review and recommendation.

Vote:  All in favor

 

CORRESPONDENCE

 

         Mayor Voros acknowledged receipt of the Notice of Amended Filing and Public Hearing in the matter of the Petition of South Jersey Gas Company to change the level of its basic gas supply service clause.  He also stated for the record that the Township Clerk sent a letter to the NJ Department of Transportation regarding the establishment of speed limits for roadways in Deer Chase and Rolling Meadows Estates.

 

AUDIENCE PARTICIPATION

 

         Valerie Nagy, Pittsgrove, wanted to know what the money was not used for per the ordinance introduced earlier reappropriating $26,000?  Mayor Voros responded that a public hearing on the ordinance will be held at the next meeting and that questions would be answered then. Mrs. Nagy then asked about the status of improvements to the Senior Center and what another $400,000 grant application is being submitted for.  Mayor Voros responded that the current grant (Phase I) focused on bringing the building into compliance with the requirements of the Americans with Disabilities Act. Improvements primarily are separate men’s and women’s bathroom facilities, an elevator to get from one floor to the next, a lift for the stage, a new septic tank, minor plumbing and electrical work, etc.  The next application (Phase II) would be to improve the mechanical systems by upgrading the heating system, replacing the boiler, adding air conditioning, etc.  Mrs. Nagy stated that she is flabbergasted at the costs going into this project.  She commented that although grant funds are being received and applied for that the township is still responsible to contribute to the costs.  Mrs. Nagy stated that in three years her taxes have gone up $2,400.00.

 

         Tony Bauer, Pittsgrove, expressed his concern about the cost of property taxes.  He moved here a year ago and his taxes have gone up $1,200.   He feels people are being forced out because of property tax increases and that there are lots of things we don’t need. Mr. Bauer stated that he has worked for twenty years to afford his home.  He plans to become involved and is going to encourage people to come out and vote.  Mayor Voros informed him of when other tax entities, the school and county, meet.

Cheryl Chambers, Pittsgrove, recapped the improvements relative to Phases I and II for the Senior Center and asked when the building could be used.  Mayor Voros responded that there will be limited occupancy of the building after Phase I improvements are completed.  Committeeman Martin was disturbed to hear about limited occupancy and Committeewoman DuBois agreed.

 

         There being no further comments from the public, a motion was made by Hargus and seconded by Martin to close the audience participation segment.

EXECUTIVE SESSION

 

         On a motion by Hargus and seconded by Martin, RESOLUTION NO. 2005-134 RESOLUTION AUTHORIZING EXECUTIVE SESSION to discuss pending litigation, anticipated litigation, attorney/client privilege and contract negotiations was approved as read.

Vote:  All in favor

 

Minutes of the Executive Session will be made available for public review with respect to matters involving litigation after said litigation has been resolved and all periods of appeal have expired and with respect to other matters within (90) days.

 

         On a motion by DuBois and seconded by Martin, the meeting was reopened to the public.

         On a motion by DuBois and seconded Hargus, the Mayor and Township Clerk were authorized to execute the Tri-Party Agreement between K. Hovnanian at Pittsgrove, LLC, Genco Homes - Parvins Mill, LLC and the Township of Pittsgrove, Re:  Edgewood Estates.
